VACATION RENTAL AGREEMENT
THIS AGREEMENT IS NOT A LEASE AND CONVEYS NO RIGHTS IN REAL PROPERTY AT ANY TIME. YOUR USE IS LIMITED TO THAT DEFINED HEREIN.

• The number of people on the property may not exceed the number of guests in your reservation confirmation plus two (regardless of whether they are staying the night or just visiting). Additional guest fees starting at $65 per person per night will apply for any unauthorized persons.

• Your sole right to access the property begins with the 3PM check-in and ends at the 11AM check-out, unless other times are approved in writing in advance. Check-in is not allowed after 9PM unless approved in advance. We will charge 50% of the daily rate for an unauthorized early arrival or late check-out.

• Dogs are allowed with prior written permission, with the payment of an additional cleaning fee, and only at certain properties. Dog owners agree to the following additional rules: use protective sheets that we will leave out for you to cover any place where your dog may lie (we are not equipped to shampoo furniture or rugs or dry clean bedding after your departure); dogs must be leashed at all times when outside (there are coyotes in the High Desert, which present danger to unleashed dogs) and owners must immediately pick up after their dogs and deposit waste in a plastic bag and place it in the garbage bin; dogs are not to be left unattended in the property at any time. In addition to our additional dog cleaning fee, we will deduct the costs of extra cleaning or repairs necessitated by the presence of your dog. If you bring any animal to
a house that does not allow pets, you will be charged a $500 fee for deep cleaning and dander removal.

• Recreational vehicles, motorcycles and camping or other overnight accommodations outside the property are not allowed. Violations of this policy will result in termination of the reservation with no refund.

• We do not guarantee the speed or availability of internet service. Internet service may be provided by a satellite and/or wireless provider and may be subject to more fluctuations and outages than you may be used to. We do not provide refunds or discounts due to internet problems that are related to the provider or weather. No illegal or abusive use of the Internet is allowed.

• Cell service may not be available at the property due to the rural nature and geography of the area.

• The High Desert occasionally has power outages due to its rural nature. We are not responsible for any outages of Southern California Edison or any inconvenience such outage may cause. We will notify you of any planned outages and if requested will attempt to accommodate you elsewhere in the event of a planned outage lasting more than 4 hours. But we do not provide refunds or discounts for power outages that are unplanned.

• No photoshoots are allowed on the property without prior written approval and the payment of additional fees. Unauthorized use of the rental property’s name, address, or images, including its interior, exterior, and / or private property surroundings, for any commercial use including but not limited to selling, advertising, TV, film production, electronic, or other media, is not permitted and we will seek to have any unauthorized use removed.

• Special events such as weddings and parties are not permitted without written approval and the payment of additional fees.

• Guests who utilize a property’s hot tub, pools and/or plunge pool do so at their own risk and we are not liable for any personal injury or other damages associated with such use. Guests may not use glass or pottery glassware, plates, etc. in or anywhere near any such water amenity. If any glass or pottery ware is broken in or near a water amenity, you will be charged the full amount to drain and refill the amenity and for any lost revenue during such service. Guests may not leave minors unattended at any hot tub, pool or plunge pool. If a water amenity is left uncovered, you will be charged a minimum of $100 for additional cleaning/filling/heating.

No lifeguard is on duty; the primary guest on the reservation is responsible for the safe operation of the pool and for the safety of any persons using the pool; by utilizing any pool or spa all guests acknowledge and accept the risk of injury resulting from use of the pool, malfunction of pool equipment, tripping or falling around the pool/spa and any other injuries that may occur and waive all claims against the homeowner or its representatives including Homestead Modern LLC.

• Guests shall allow the property owner or any designated workers access to the property for landscaping and routine maintenance, cleaning, repairs and building inspections, and pool and hot tub repairs and service.

• If for any reason beyond the control of the owner, the property is unavailable, we may cancel your reservation and refund the actual fees and / or deposits you have paid.

• Smoking is not allowed inside the property or within 15 feet of any exterior door. Please dispose of your extinguished cigarette waste in a plastic bag and then into the outdoor garbage can. Do not leave cigarette waste on the grounds. If these rules are violated, we will charge a minimum of $250 for remediation.

• Propane firepits or fireplaces may not be used for burning wood or any other materials (it is illegal pursuant to a county ordinance and may damage the fixture). If any combustible materials are burned in them, we will charge a minimum of $500 cleaning fee.

• By making your reservation, you confirm that you will comply with (and your stay is allowed by) any applicable health or safety orders from the State of California.

• Firearms are not allowed on the property.

• Local ordinances prohibit any loud, excessive, or intrusive noise that disturbs the peace or that causes discomfort or annoyance to any reasonable person at any time as well as strict quiet hours between 10PM and 7AM.

• Please pay attention to all relevant short-term rental ordinances and other regulations (such as the noise ordinance above) in accordance with county or town guidelines. If you violate any ordinance and as a result the property is fined, you will be responsible for payment of the fine plus a $500 administrative fee.

• Payments are due 50% at 60 days before check-in and 50% at 30 days before check-in (or at the time of reservation if less than the days for either payment). For bookings made directly on our website, no cancellation is allowed less than 5 days before check-in (100% of the charges and booking fees are non-refundable at that time).

• A deposit is required at the time of booking and any unused portion will be returned 7 days after checkout. Bookings made directly on our website or through Vrbo are charged an accidental damage protection fee – with payment of this non-refundable fee, you will not be held responsible to pay for accidental damage or loss to the rental property resulting from you or others in your party up to $1000 and that you report to us during your stay. This plan does not cover intentional acts of a guest, gross negligence, or willful and wanton conduct, and/or damages caused by pets.

• We may withhold all or part of your deposit if you fail to follow the rules in this agreement, the property listing or the property house manual. If the cost of the damages, losses, or missing items exceed the amount of the deposit, we will bill your credit card for the difference and / or pursue legal action. Cause(s) for withholding deposit funds include, but are not limited to: damage to premises or contents, missing or broken items, lost keys, required excessive cleaning, not complying fully with the departure checklist, smoke odors or damage, mailing charges for items left behind, unauthorized persons visiting or staying on the property, the presence of a dog without authorization, noise complaints after 10PM, including fines, trespassing on neighboring properties, violation of any county or town rules and unauthorized late check-out.

Incredible spot! So close to the park! Really 1 minute away from the west entrance. I do a lot of star trail photography and landscape photography in Joshua Tree National Park and this little gem was the perfect base for a few days of taking photos. I will definitely be coming back. If you want a place that is a stones throw away from the entrance, you can’t beat it!

Very cool place. Tons to do. The host was amazing. My recommendation is to check in during day hours. I got a bit lost at first because I showed up at night. Joshua Tree has extremely low light pollution by design. I got a bit turned around, but nothing too bad, the hosts talked me through it. Thank you for a very special trip. I loved it.

I love Joshua Tree and this was the perfect location. Just a few minutes drive into JTNP entrance. Extremely convenient when you’re chasing the sunrise inside the National Park. Perfect little house for couples getaway. Home was clean and well equipped to my high standards. Back yard view is amazing! Easy to find and host were extremely proactive in giving instructions. I would definitely come again for my next visit.

My husband and I go to Joshua Tree all the time. We love the town and love being able to bring our dog. Quails Nest was a wonderful small space for the 3 of us. They even provided, if needed amenities for our dog. The back of the property opens out to the National park with no other homes in sight. It is absolutely beautiful. And a trail into the park just steps from the property. Highly recommend this place for the location. They also provided a very clean place with all the necessities for a long weekend.

Quail’s Nest was the perfect place to enjoy the area near Joshua Tree National Park. The place is a stone’s throw from the park entrance. The yard boasts gorgeous views from the front patio and a spectacular sunset. The place itself was impeccably clean and amenities like a coffee maker and a breville counter top oven are nice. While the house is just off the road and easy to find there is a wall that blocks out all the road noise and adds to the privacy. Would stay here again if visiting JTNP!

Absolutely outstanding place! Loved everything about it. Gorgeous views to have your coffee on the patio. Quiet and serene, with a secluded jacuzzi that was delightful at dusk. The amenities are spot on, separate air con for front room and bedroom. The small cooker was great for breakfast. Delicious coffee. Very comfortable bed, slept very well. Super close to the Joshua tree west entrance and a short drive to restaurants and shops. Truly recommend this place, it was an absolute delight.

Everything was awesome! Being right outside the park was perfect. The home was very comfortable, well kept and quiet even being right on the road to the park. The bed was very comfortable, with clean fresh linens and big pillows. I usually have to use my own pillow, but yours were so comfy, I didn’t even think about it. The walk-in shower was wonderful and the outdoor one was great for use right after the jacuzzi. I loved the fact that there is no one directly behind the home and you have an amazing view of the mountains. Sitting in the Adirondack chairs having a nice cuppa each morning, listening to the wildlife, just can’t beat that.

My boyfriend and I really enjoyed our stay here. The proximity to the JT National Park entrance made it so convenient for getting in and out of park at anytime in the day or night. We grilled and used the hot tub, which was such a nice relaxing end to our long days. It was exactly what we were looking for in our getaway. Would recommend to others!

Loved the stay and beautiful porch-side view of the desert. Close enough for feet-in-the-sand! Minimalist style, functional kitchen. Peaceful nights. We got used to the road-noise pretty quickly. The Quails Nest description doesn't do this place justice. My only regret was we didn't stay longer. The home was so and peaceful with tranquil views overlooking the mountains. Perfectly decorated and supplied to the T. The house was a few minute drive outside of the park, and close enough to town to enjoy shopping and restaurants. Overall I would highly recommend this home to my friends and family.

What a phenomenal home!! The location was perfect—so close to the park entrance, there were even trails right off the backyard—and the tranquility of looking out into the desert from the rental was unbelievable. I didn’t see many homes in this area that could have had the same open desert and solitude that this one offered due to its location at the top of the road facing the park. Indoors it was super cute. You could look out into the desert while lying in bed or stargaze from the hot tub. I couldn’t have found a better place and location on my solo trail running adventure through Joshua Tree.

This place was truly a gem. It is rare that a rental is better in person than it is in the listing pictures. The entire residence was very clean and super cute. They had very soft towels, nice shampoo/conditioner/soaps and all of the basics you need. We sat in the hot tub every night and stared at the stars. We could see the milky way. Check in was very easy and convenient, it was easy to find. It was a little close to the road for my liking, but you could not hear any road noise at all from inside, so the location didn't matter. The back view is incredible and nearly every kind of cactus in Joshua Tree is visible from your room. Waking up to the view of the mountains was so great. I would 100% recommend this place.

Spent the weekend here with my girlfriend for my birthday and it was exactly what we were looking for. Very peaceful and tranquil place to stay. The backdrop landscape was spectacular and we enjoyed just sitting in the porch and watching the sunset and admiring the landscape with our coffee/wine. The hot tub and heater were already on when we arrived which was very thoughtful allowing us to settle in right away. The place makes you feel secluded enough to have your privacy but not too secluded that you're far away from town. We will definitely be back here.

Staying at the Quail's Nest was wonderful. It is literally in the backyard of Joshua Tree National Park with spectacular views of the environment. Sunrise and sunsets were spectacular and star gazing from the hot tub was a definite highlight. Overall the experience was great. The home is cozy and has the basics. Wish the water pressure in the shower was a bit better since after a long day in the dessert, you want to get a nice clean. Other than that, no real complaints.

Tranquil desert escape. My boyfriend and I just spent a wonderful three and a half days in this beautiful and serene desert cabin. The first night we saw a shooting star, the second night we were treated to a spectacular sunset, and the third night we heard coyotes in the distance. Quail’s Nest was charming, comfortable, incredibly close to Joshua Tree National Park for excursions, a short drive into town for food and most importantly (having just come from a hotel in Palm Springs near some massive construction noise), it was quiet. It also has amazing views of the surrounding desert hills. We both had a wonderful time and we can’t wait to come back.

We would re-book this sweet abode in a heartbeat if we visit Joshua Tree again. The location was *perfect* - we were unfamiliar with the area and it was right in the middle (very easy drive) of eastern hiking areas, the western Yucca Valley for shopping, and quick direct access to Joshua Tree. It felt completely secluded and private with the MOST incredible view for morning coffee and evening patio drinks. We enjoyed using the hot tub nightly and had everything we needed for kitchen/household amenities. Additionally, the furniture and linens were beyond comfortable - the couch, bed, and towels most especially - and they have taken the most intentional care with making it incredibly comfortable. (I went out of my way to peek at towel + sheet tags so we can order them for our home!) Check-in and check-out was seamless and communication was quick and easy! We are SO appreciative of being able to have found this impeccable home to stay in for our vacation. It met and then exceeded any/all expectations for what we wanted in our visit!

This is one of the best Air bnbs I’ve ever been to. The house is 0.5 miles away from the park entrance and close to some of the best hikes in Joshua tree. It’s also a short drive from cute restaurants! The best part is the house itself. The decor makes the house feel like a home away from home and the outside amenities are amazing. You can wake up to the desert mountains in the morning and go to sleep under the stars at night. You can even see the Milky Way from the hot tub. Absolutely stunning!

Just returned from a wonderful and relaxing stay at the Quail's Nest. It was peaceful and tranquil due to its location distant from noise and light allowing for wonderful nighttime star gazing in the jacuzzi. The house has everything that was needed for a delightful stay including coffee, stocked kitchen, luxurious towels, bathrobe, grill, and a wonderful outside shower. The outside shower was especially nice after a long hike. The indoor and private outdoor space was just perfect for my needs. It was also conveniently located adjacent to the west entrance to JOTR National Park and just up the road from Joshua Tree. I thoroughly enjoyed my stay and plan to return for a longer stay in the near future.

Beautiful spot, well appointed, kind of like a big suite at a hotel, smaller kitchen, no stove but some other appliances to get around that (like electric griddle and electric tea pot, microwave, plus the bbq outside that was well stocked with propane) small fridge with a small freezer (but I still fit my big Yeti ice block and two smaller ones plus extra smaller igloo ones) Even though the property is basically right next to the road it was actually pretty quiet, the house is well insulated so road noise is minimal, and then the house itself acts like a buffer when you’re out on the porch looking at the most beautiful valley view of various plants, Joshua trees and the mountains in the distance. I’m pretty sensitive to noise, and road noise out here at our stays in the desert, and it was a truly quieter stay compared to some that technically were not on a ‘main’ road. Very clean, and the bed was super comfortable but soft (in a good way) dreamy, and very nice linens. Two AC/ Heat units, (one in bedroom one in living room) both worked well. I enjoyed yoga on the covered patio in the morning with chipmunks and road runners coming very close, and all the bird song from Many birds around (month of May). Didn’t try the jacuzzi but it was in a cozy spot, and I’m sure would have been nice, just didn’t work out timing wise on a short 2 night stay (busy with exploring). All the reviews are glowing, and I see why. Property/location and overall amenities are far above average. Communication was a little spotty, and I’m just not sure what I should expect in terms of response time. I’d ask a question and get a very polite “well check on that” kind of response and wouldn’t hear back after that. I’m not sure what a realistic expectation should be there. But if you think you might have questions I’d get them submitted /notified a day or two early of your stay if you really want/ need an answer. None of my stuff was really critical, so I just kinda let it go. I’m sure in emergencies (or I’d hope) they’d respond with actionable/answers. But my requests weren’t critical so..,idk I just didn’t worry about it, as they obviously weren’t concerned about it enough to give me an answer. Overall, I’d stay again, depending on what type of kitchen/cooking situation I wanted/needed. Very restful and surprisingly peaceful spot. And lots of well thought out and expected comforts were there plus some nice touches (waffle knit robes and extra blankets/towels for jacuzzi etc.) Big picture: Expectations were exceeded in terms of what the stay and location offers.

Absolutely perfect little place to call home for our trip to the desert! Upon checking in we noticed a little gift and a note that was left for my wife’s birthday- so thoughtful! We had absolutely everything we needed and there were a few days where we decided just to stay at the house and do absolutely nothing at all. The hot tub is perfect for relaxing and watching the stars. Possibly the best thing was the location! We were just minutes away from the National Park entrance and a short drive from town. This is our second time at the Quail’s Nest - a lovely home just outside the park entrance. The view of the valley is beautiful and sunrises with a hot beverage are something to experience. The Nest is the perfect size for our family of three (pup, included) and offers easy access to those wishing to spend the most time in the park. Perfect for a Joshua Tree getaway. The backyard view has got to be one of the best in all of Joshua Tree. Just a place to immerse in the simplicity of things! Small but comfy and you’ll want to spend all off your time enjoying the view outside anyway. I do wish there was a fire pit. This would be a wonderful addition! The home is situated very close to the road but they did an excellent job of putting walls around that really focus your attention to the incredible view of the back, so you don’t feel too close to the road.

We loved our stay! We brought along three dogs with us, and all of them shared equal enjoyment. One thing worth mentioning regarding the kitchenette is that the Breville set off the smoke detectors when I was toasting a bagel. Otherwise, it was extremely useful for cooking everything else. All of the cookware provided enough means for us to make three square meals a day. Another thing worth mentioning is that hikers use the property to get to the trail behind the property line. Kind of odd when we were just relaxing outside with the dogs, but it didn't bother us too much. Last thing to note is that there is road noise. Star gazing was fun and all until you heard the epic hums of off-road vehicles making their way to Joshua Tree. Overall, we really enjoyed our stay here. It was private enough for us and our dogs, the views were spectacular, and everything was setup so perfectly in the house for a quiet getaway.

The Quails Nest was the perfect get away for my wife and I. The space was clean and the location was perfect. You look out bedroom and living room and you are greeted with a beautiful mountain back drop filled with Joshua Trees.

Fantastic Airbnb. Very very close to the West Entrance of Joshua Tree and very close to the main road where all the restaurants are. Only downside I would say is that there is only a hot plate for making food, which I should have thought about a little more in retrospect so we unnecessarily brought some groceries that we didn't end up using. Otherwise they even had a walking stick, flash lights for star gazing. We loved the hot tub after a long day of hiking too.

By far the best Airbnb I’ve stayed at yet. The view is stunning, the home is beautifully decorated, and the bed is so comfortable! The hosts were very responsive and kind. Would absolutely stay here again in the future.
